General Terms and Conditions of www.collector-shop.ch
1. Provider and scope
These General Terms and Conditions apply to all orders placed via www.collector-shop.ch
The provider is the sole proprietorship Wyss Collectibles, Obergerlafingen, Switzerland.
By placing an order, the customer accepts these General Terms and Conditions.
Swiss law applies exclusively. The place of jurisdiction is Obergerlafingen.
2. Offer and conclusion of contract
The product listings in the online shop are non-binding and do not constitute a binding offer.
By placing an order, the customer submits a binding offer to purchase.
The contract is concluded when the goods are shipped or a shipping confirmation is sent.
We reserve the right to reject orders in the event of obvious errors or delivery problems.
3. Prices and payment
All prices are in CHF and include statutory VAT, where applicable.
Payment is made directly at checkout using the available payment methods.
The price at the time of ordering is decisive.
4. Shipping and delivery
Shipping area
Deliveries are made exclusively within Switzerland and Liechtenstein.
Shipping methods
Shipping is handled by Swiss Post as follows:
- A-Post Plus (letter mail with tracking) – for TCG cards and small shipments
- PostPac Priority (parcel shipping) – for larger orders such as displays, model cars, or combined goods
We reserve the right to subsequently adjust the shipping method depending on the product size, weight, and order composition, provided this ensures safe, efficient, and appropriate delivery. This will not result in any additional costs for the customer.
Delivery time
The delivery time is generally 1–3 business days within Switzerland.
Delays caused by shipping providers or logistical circumstances are possible.
Shipping Costs
Shipping costs depend on the shipping method and product size:
- CHF 3.40 for TCG cards and small shipments (A-Post Plus)
- CHF 8.50 for parcel shipping (PostPac Priority)
Shipping is free for orders of CHF 100.– or more.
5. Preorders
Part of our product range consists of preorders in the areas of Trading Cards, Collectibles and Model Vehicles (e.g. Pokémon products, TCG sets, Hot Wheels, model cars, displays, or comparable items).
The following conditions apply to preorders:
Delivery Dates
Specified delivery dates are non-binding estimates provided by the manufacturer or supplier.
Delays are customary and possible in the area of collectibles and licensed products.
Delivery Delays
Withdrawal due to delivery delays is generally excluded unless mandatory legal reasons apply. In special cases, we will endeavor to find a fair and customer-friendly solution.
Unavailability / Production Discontinuation
If a preordered product is not produced, not delivered, or becomes permanently unavailable due to the manufacturer or supplier, we are entitled to withdraw from the contract.
In this case, payments already made will be refunded in full. No further claims may be made.
General information about preorders
Preorders are subject to the production and delivery conditions of the respective manufacturers. These are beyond our control.
6. Products, Conditions, and Collectibles
Product images are for illustration purposes and may differ.
Minor variations in color, packaging, or details are possible.
Trading Cards (RAW)
Condition descriptions (e.g. Near Mint) represent a customary commercial assessment.
In particular, the following may occur with ungraded cards:
- Minimal production or printing variations
- Minor surface, edge, or handling marks
- Minor storage or packaging marks
These do not constitute a defect, provided they meet the usual collector's standard.
Sealed Products (sealed collectibles)
For sealed products (e.g., Pokémon displays, booster boxes, ETBs, Hot Wheels Cases, LEGO sets, or comparable items), the sale is made in the unopened original condition.
The goods originate from regular distribution and wholesale channels.
As part of production, storage, or quality control, packaging may have additional or renewed seals (e.g., adhesive tape). These are standard in the industry and do not affect the originality or contents.
No guarantee is provided for:
- specific contents, models, or rarities
- Completeness of individual sets
- Condition of the individual products included
The contents are subject to random selection and production variations.
Graded Cards
For Graded Cards (e.g., PSA, CGC), only the rating assigned by the respective grading organization shall apply.
7. Warranty
The goods must be inspected upon receipt.
Defects must be reported in writing within 14 days.
In justified cases, we will, at our discretion, provide a replacement or refund.
No warranty is provided for:
- industry-standard collector variations
- packaging damage that does not affect the contents
- improper handling or storage
Statutory claims remain reserved.
8. Returns
There is no statutory right of withdrawal in Switzerland.
Returns are generally not offered.
In exceptional cases, a goodwill solution may be possible.
9. Liability
We are liable only in cases of intent or gross negligence.
Liability for slight negligence is excluded to the extent permitted by law.
We are particularly not liable for:
- delivery delays caused by shipping service providers
- transport damage caused by third parties
- improper use or storage
- technical problems with payment providers
10. Data Protection
Personal data is used to process orders. If the customer consents, it may also be used for marketing purposes (e.g., newsletters).
For processing purposes, data may be disclosed to payment and shipping service providers (e.g., Shopify, postal services, payment providers).
No disclosure to uninvolved third parties.
11. Note on Collectible Values
All products are collectible items.
Market prices and values may fluctuate.
No guarantee regarding value appreciation.
12. Final Provisions
Should any individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
